Terms and Conditions

  1. Prices are valid for 30 days from the date of quotation.
  2. Prices quoted are exclusive of VAT which will be charged in addition where applicable.
  3. All prices include personalisation where applicable.
  4. For mainland UK, price includes delivery, installation and for sundials, alignment (alignment requires sunlight; in its absence clear instructions will be provided).

  1. Lead Times for our work are typically 16 weeks. We will provide you with an accurate lead time once we have received your deposit and your Signed Order Confirmation and where required your signed Personalisation Form.
  2. For export, instructions for installation will be provided, the cost of packaging is included and shipping is available on request (payable in addition). Any importation duties, taxes or other levies on importation are the responsibility of the purchaser.
  3. A 50% deposit is due on placement of all orders.
  4. Any bank charges for international payments must be bourne by the client.
  5. All deposits are non-refundable once the order confirmation has been issued to the purchaser.
  6. For mainland UK, the balance of monies due is payable in full on the installation or delivery of product.
  7. For export, payment is required in full prior to any goods being shipped.
  8. If the purchaser is unable to take delivery within three months of being notified that the product is ready for installation or despatch then the balance of the sales price will become payable one month after such notification and the purchaser may subsequently incur storage charges at David Harber Ltd's standard storage rate tariff.
  9. Mileage where applicable will be charged at 45p per mile. Labor and travelling time will be charged at the standard labor rate £70.00 per hour per operative including travelling time where applicable.
  10. Each product can be personalised. All personalised information must be confirmed by signing and ticking the Personalisation Form. Should any change be required after the Personalisation Form has been signed and once the item has gone into production, David Harber Ltd will charge a minimum of £800 for any changes.
  11. Any amendments made to the technical drawings after the Drawing Approval Form has been signed will be charged for at our standard labor rate.
  12. In the event that a commission has not been completed and delivered within 6 months of the order being placed by reason of the purchaser's failure to complete, sign and tick the Personalisation Form or other failure on the purchaser's part, David Harber Ltd reserves the right to to increase by 10% of the contract price.
  13. If pumps are required to run continuously this must be advised at the point of sale and will be confirmed on the order confirmation.
  14. All products supplied remain the property of David Harber Ltd until payment has been received in full. The purchaser grants to David Harber Ltd its employees and agents an irrevocable licence to enter any premises where the goods are stored, installed or believed to be, for the purposes of retaking possession of the product(s).
  1. In the event of payment not being received by the due date, interest may be charged at the rate of 1% per month or part month on any outstanding balance until the payment is made in full.
  2. It is the client's responsibility to prepare the site for installation in accordance with the recommendations of David Harber Ltd. Should the site not be prepared as specified and as a result of this additional work is required by David Harber Ltd or the installation is delayed, then David Harber Ltd will charge for any additional labor at the standard labor rate, mileage and materials required. David Harber Ltd will advise on site preparation but will not be responsible for any work conducted by a third party in this regard.
  3. In the event that the site has not been prepared In accordance with the David Harber Ltd specification and in the opinion of a David Harber Ltd employee is unsuitable for installation of the product(s), David Harber Ltd reserves the right to charge £750 for an abortive site visit.
  4. On the installation of certain products additional labor may need to be provided by the client and this will be indicated at confirmation of order.
  5. David Harber Ltd will not be responsible for any damage caused by any person other than in its employ and will not be responsible for injury sustained by any third party.
  6. David Harber Ltd is committed to the promotion of health and safety and proper regard for the environment in respect of all its activities. In circumstances where David Harber Ltd issues health and safety data sheets for commissions, the purchaser shall be responsible for ensuring that its employees, contractors and users read and observe the instructions and recommendations in them.
  7. All control boxes are PAC tested in our workshop. The final connection on site must be arranged by the client and must be undertaken by a NIC EIC qualified electrician who will need to provide the purchaser with an electrical installation certificate. Failure to obtain an electrical installation certificate will invalidate the warranty.
  8. On receipt of the client's signed Personalisation Form, best endeavours will be made to ensure the delivery of the products within 3 months, or where agreed to a more pressing deadline.
  9. In the event of a shipment being received damaged, please sign the delivery agents paperwork as damaged. Under no circumstances discard the delivery crate. Photos of the damaged sculpture and crate need to be sent to David Harber Ltd within 24 hours of arrival.Failure to comply with any of the above procedures will invalidate your guarantee.
  1. David Harber Ltd will give a one-year guarantee on all products including major electrical parts, pumps, filters etc subject to fair wear and tear. After one year any maintenance repairs or change of parts will be charged at the standard labor rate. Mileage and materials will be charged in addition.
  2. Where appropriate David Harber Ltd will supply a maintenance schedule. David Harber Ltd will not be responsible for any failures which in David Harber Ltd's opinion results from untimely or poor maintenance. Such untimely or poor maintenance will invalidate the warranty.
  3. David Harber Ltd will manufacture all products in accordance with their appropriate use and does not accept responsibility for any failure of a product resulting from negligence, vandalism, inappropriate or unreasonable use, incorrect installation or the product being moved other than by David Harber Ltd employees or appointed representatives.
  4. Because of the natural nature of our products and the processes employed in their manufacture, there may be minor colour variations between product supplied, samples and illustrations.
  5. This agreement shall be governed by and construed in accordance with English law. Each of the parties irrevocably submits for all purposes in connection with this agreement to the exclusive jurisdiction of the courts of England.
  6. David Harber will not be responsible for natural processes such as oxidation which may change the colour of metals over time.
  7. All Intellectual Property Rights, design rights and the like in the commission shall be and remain property of David Harber Ltd and the purchaser shall not be entitled to or claim, and shall procure that its affiliates, associates, agents and buyers from the purchaser do not claim ownership of any such Intellectual Property Rights. Nothing in this agreement shall give the purchaser, its affiliates, associates, agents or buyers from the purchaser any proprietary interest in the design of the commission which cannot be copied without the consent of David Harber Ltd.
  8. The purchaser agrees that the commission will be used by the purchaser in the form in which it is received and, in particular, without addition, adulteration, alteration or contamination of any kind whatsoever. The purchaser further agrees not to alter the decoration or visible design of the commission in any way or to remove, obliterate or otherwise deface the David Harber Ltd marks appearing thereon.
  9. The purchaser agrees that this agreement cannot be considered as a transfer of design rights, IP rights, branding rights, trademarks or copyright held by David Harber Ltd.
  10. Any indemnity or relief from or limit of liability in favour of David Harber Ltd shall extend to and apply for the benefit of their respective directors, employees and authorized agents
